Disability Discrimination Litigation

Leone Alberts & Duus is experienced in defending cities and school districts against claims of disability discrimination, including issues of public access to facilities and achieving compliance with state and federal public access laws.

Our experience further extends to defending claims of disability discrimination in the public school setting, including claims based on rights to a Free and Appropriate Public Education arising out of the Individuals with Disabilities Education Act, and claims brought under Section 504 of the Rehabilitation Act, the Americans with Disabilities Act or both.

We also have ample experience defending against claims of disability discrimination brought under state law, including Government Code Section 11135 and the Unruh Act.  Our experience working with public entities and educators to untangle the web of state and federal compliance requirements allows us to shape the litigation strategy and place the city or school district on the path of best compliance.
