Each attorney at Leone Alberts & Duus has extensive experience defending public entities in tort liability actions and has a comprehensive understanding of the claims presentation requirements and immunities in the Government Claims Act. We represent cities and other public entities in all variety of tort liability cases, including dangerous condition of public property, employee negligence, negligent hiring, supervision, and retention, false arrest, wrongful death, catastrophic injury, assault, child abuse, injury to property, nuisance and mandatory duties.

Our attorneys have collectively tried over 40 tort liability cases to defense verdict, including the first toxic mold lawsuit brought against a public entity in California. Additionally, we have an excellent track record of using the defenses and immunities in the Government Claims Act to obtain dismissal at the pleadings stage or summary judgment.

We also know that frequently our clients have indemnity agreements that may provide defense, indemnification or additional insurance coverage for injuries occurring on their property. In such cases, we have been successful in obtaining defense and indemnification for the public entity often without the need to file a lawsuit for breach of the indemnity agreement. We have also used good faith settlement motions to shield our clients from further liability to joint tortfeasors, such as product manufacturers and contractors.
